Özet: Bu makalede, ilkin, Ernst Fraenkel’ın Der Doppelstaat’ta nasyonal-sosyalist devletin ‘norm devleti’ ile ‘imtiyaz devleti’ şeklinde ikili düzeyde iş gördüğü yönünde ileri sürdüğü tezin, günümüzde neoliberal ütopyanın devlete, hukuka ve bireylere biçtiği rolü aydınlatmada rehber alınabileceği ve Nazi devletinin Yahudilerle Arîler arasında yaptığı ayrıma benzer şekilde, paydaşlarla paydaş olmayanlar arasında bugün yapılan ayrımın, halkın büyük kesimini ‘çıplak hayatlar’ sürmek zorunda bırakarak ‘sivil ölüme’ mahkûm ettiği iddia edilmektedir. İkinci iddia ise neoliberal ütopyanın, daha önceki ütopyalara benzer şekilde, dünyayı tek bir perspektife göre düzenleme ısrarı nedeniyle demokrasiyle çeliştiği, demokrasinin panoptikon benzeri simetrik bir merkezî devlet yapılanmasındansa, yurttaş katılımıyla gelişigüzel şekillenen asimetrik bir yapıyı gerektirdiğidir.

FROM RECHTSSTAAT TO DOPPELSTAAT or from welfare state to a neolıberal utopıa

Abstract: In this paper I argue firstly that Ernst Fraenkel’s main thesis put forward in Der Doppelstaat where he argued that national-socialist state operates in a dual level (normative state and prerogative state) may be indicative nowadays to enlighten the roles of the state, the law and the individuals casted by the neoliberal utopia and that similarly to the distinction made by the nazi state between the jewish and the arians, today’s distinction between shareholders and non-shareholders condemns large sections of the people to ‘civil death’ by forcing them to live ‘bare lifes’. Second thesis of this paper is that similarly to the previous utopias, neoliberal utopia contradicts with democracy because of its insistence to regulate the whole world according to the perspective of a few and that democracy entails an asymetric structure form shaped by random participation of the citizens rather than a symetric central state structure similar to the panopticon.
